1. Acceptance of Terms

By downloading, installing, or using TutorBook (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Description of Service

TutorBook is an AI-powered tutoring platform that allows users to:

Upload educational materials (e.g., PDFs, images, notes)
Generate AI-powered lessons, explanations, and study tools
Create and organize courses, collections, and shared learning experiences
Interact with AI tutors and collaborative learning features

3. User Responsibilities

You agree to:

Use the App only for lawful and educational purposes
Upload only content that you own or have the legal right to use
Not upload or share content that infringes any copyright, trademark, or other rights
Maintain the security of your account

You are solely responsible for the content you upload and share.

4. User Content & License

When you upload content to TutorBook:

You retain ownership of your content
You grant TutorBook a worldwide, non-exclusive, royalty-free license to use, process, analyze, and display your content solely to provide and improve the Service
This includes generating AI-derived materials such as lessons, quizzes, summaries, and recommendations

We do not claim ownership of your uploaded content.

5. Content Visibility & Sharing

TutorBook allows different levels of content sharing:

Private Content: Visible only to you
Shared Content: Shared with specific users via invite or code

You are responsible for ensuring you have the right to share any content you make public or shared.

TutorBook reserves the right to restrict or remove content from public or shared areas at any time.

6. Copyright Policy (DMCA)

TutorBook respects intellectual property rights.

If you believe content on TutorBook infringes your copyright, please contact us at:

A description of the copyrighted work
The location of the infringing content
Your contact information
A statement that you have a good faith belief the use is unauthorized

We will promptly investigate and remove infringing content where appropriate.

7. Repeat Infringer Policy

TutorBook may suspend or terminate accounts of users who repeatedly upload or share infringing content.

8. Content Moderation & Removal

TutorBook reserves the right to:

Remove or restrict any content at our sole discretion
Suspend or terminate accounts that violate these Terms
Limit sharing or visibility of content suspected of violating intellectual property or other laws

9. AI-Generated Content & Third-Party AI Services

TutorBook uses artificial intelligence to:

Analyze uploaded materials
Generate tutoring sessions, explanations, and study tools
Provide personalized learning recommendations

Some AI features within TutorBook, including the “Learn with AI” functionality, may be powered by third-party AI services such as OpenAI’s ChatGPT or similar models.

By using these features, you acknowledge that:

Your interactions may be processed by third-party AI providers to generate responses
These providers may have their own terms of service and privacy policies governing their systems
TutorBook does not control or guarantee the accuracy, completeness, or reliability of responses generated by third-party AI systems

AI-generated content may contain inaccuracies or errors. You are responsible for verifying important information from authoritative sources.

10. Subscriptions & Payments

Certain features are offered via in-app purchases and subscriptions managed by Apple.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period
Billing is handled via your Apple ID account
You can manage or cancel subscriptions in your device settings
Refunds are handled by Apple in accordance with their policies
Pricing may vary by region and may change prospectively

11. Privacy

Your use of TutorBook is also governed by our Privacy Policy, which explains how we collect and use your data.

12. Intellectual Property (TutorBook)

TutorBook, including its software, design, AI systems, and branding, is protected by intellectual property laws.

You may not:

Copy, modify, or distribute the App
Reverse engineer or attempt to extract source code
Use TutorBook trademarks or branding without permission

13. Indemnification

You agree to defend, indemnify, and hold harmless TutorBook and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Content you upload or share
Your violation of these Terms
Your infringement of any third-party rights

14. Limitation of Liability

TutorBook is provided “as is” without warranties of any kind.

We are not liable for:

Errors in AI-generated content
Loss of data or content
Interruption of service
Indirect or consequential damages

15. Termination

We may suspend or terminate your access to TutorBook at any time for violations of these Terms.

You may stop using the App at any time.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in San Francisco County, California.
